If the borrower falls behind regarding the mortgage payments then he should contact the lender as soon as possible. As with the speedy action the homeowner can reduce the arrears on the property. If quick action is not taken then it might lead to repossession of the property.
Initially the lender approaches the homeowner by mail or telephone for enquiring about the missed payments. The homeowner should convey the reason for it and make record of the conversations. But if the due amount is then also not paid then the lender refers the case to his lawyer. After 4 – 8 months the lenders lawyer will initiate the repossession proceedings of the property in the county court. The court set hearing date for the foreclosure proceedings and issue a summon to borrower.
The borrower need to fill a reply form issued from the county court regarding his intentions for the property. If he wish to retain the property then give proper evidence of income and its outgoings so that the court ensure that the borrower will be able to again continue the monthly installment and also some amount towards the pending arrears. If the borrower does so then the lender may suspend the proceedings after receiving these payments before the day of hearing for the proceedings.
If the borrower doesn’t make any payment and even doesn’t attend the hearing also then the court order for the possession of the property. The lender can also call for possession through Possession Warrant or eviction without any hearing if the borrower default the loan.
If the court feels that the borrower cannot pay the monthly payments then the court order for the possession. If the borrower pays off the due amount then the possession orders are suspended. Sometimes hearing cannot proceed then a new hearing date is set.
If the borrower doesn’t evict the home after possession order then court issue a letter to the borrower stating the time and date for home eviction. At notified time and date, a lender, court bailiff and locksmith formally take the possession of the house. The borrower just gets 10 minutes so as to leave the home and can collect remaining belongings further by another visit.
There are different options for the borrowers so as to save the property one should consider a mortgage rescue scheme. These schemes are run by local authorities, private companies and housing associations that buy the property so as to rent it again to the borrowers. But confirm the value and rent price of the property. It is never too late to have an advice and there are on-the-day emergency legal help desks in court where a borrower can get some relief and help.
